Introduction and Acceptance

These Terms of Service ("Terms") govern your access to and use of PixCutly, an AI-powered creative platform owned and operated by Ainan Signage Company.

By accessing or using PixCutly websites and services (including pixcutly.com and related PixCutly experiences we operate), you agree to these Terms and our Privacy Policy. If you do not agree, do not use PixCutly.

Eligibility

You must be legally able to enter into these Terms. If you use PixCutly on behalf of an organization, you represent that you have authority to bind that organization.

Description of PixCutly

PixCutly provides digital creative tools that may include:

• Image background removal and related image tools
• AI creative and image tools
• AI Voice / text-to-speech
• AI Video generation
• AI Song generation
• AI BGM / music generation
• AI website drafting / site builder features
• User accounts and related studio experiences

Features may change, be limited, experimental, or unavailable at times. Some features shown in the interface (for example Professional Email UI or decorative credit displays) may be preview-only and not fully connected until we say otherwise.

User Accounts

Some features require an account. Authentication may use third-party services such as Supabase and Google sign-in.

You are responsible for:

• Keeping your login credentials secure
• Activity under your account
• Providing accurate account information

Notify us promptly if you suspect unauthorized access.

User Content

"User Content" means material you submit to PixCutly, including prompts, scripts, text, uploaded images, audio, video, files, messages, and similar inputs.

You retain whatever rights you already have in User Content you own or control.

To operate PixCutly, you grant Ainan Signage Company and its service providers a limited, worldwide, non-exclusive license to host, transmit, process, transform, and display User Content only as needed to provide the features you request, maintain security, prevent abuse, and comply with law. This license ends when User Content is no longer needed for those purposes, except for copies retained in backups, logs, or as otherwise described in the Privacy Policy or required by law.

You represent and warrant that:

• You have all rights and permissions needed to submit User Content and to authorize this processing
• Your User Content and your use of PixCutly will not infringe others' rights or violate law

PixCutly does not claim ownership of your original User Content solely because you uploaded or submitted it.

AI Processing

Some features use artificial intelligence and may send User Content to PixCutly systems and/or third-party AI providers (including Google AI / Gemini APIs and OpenAI, where implemented) solely to fulfill your request.

You understand that:

• AI processing is automated and may involve third-party systems
• Inputs may be processed according to those providers' terms and privacy policies
• PixCutly does not guarantee that prompts, uploads, or outputs are never retained in every system involved in delivering a feature

Generated Content

"Generated Content" means outputs produced in response to your requests, such as processed images, speech audio, video, music, song audio, website drafts, or other creative results.

Regarding Generated Content:

• Results may be incomplete, inaccurate, biased, offensive, non-unique, or unsuitable for your purpose
• PixCutly does not claim that Generated Content is unique, error-free, or guaranteed copyrightable
• PixCutly does not automatically grant you ownership of every AI-generated output; rights may depend on applicable law, your inputs, and third-party provider terms
• You are responsible for reviewing Generated Content before use, publication, or commercial exploitation
• You are responsible for obtaining any additional rights, licenses, clearances, or permissions required for your intended use

Where a feature returns a downloadable or playable result, you may use that result subject to these Terms, applicable law, and any applicable third-party provider terms. We do not promise commercial-use rights that provider terms may restrict.

Image Processing and Background Removal

Background removal and related image tools are automated. Results may vary based on image quality, lighting, subject complexity, edges, transparency, resolution, and other factors. PixCutly does not guarantee perfect results for every image.

Temporary processing files used for background removal are cleaned up after processing according to our technical process. Operational metadata or logs may still be retained as described in the Privacy Policy. You should keep your own originals and downloads.

AI Voice

AI Voice generates speech from text using selected voices and settings. You must not use AI Voice to:

• Impersonate a real person without lawful authorization
• Commit fraud, deception, harassment, or other unlawful acts
• Create misleading synthetic speech in ways that violate law or others' rights

You are responsible for how you use generated speech.

AI Video, Images, Music, and Song

You are responsible for AI Video, AI image, AI Song, and AI BGM outputs you create or download, including whether they are lawful, non-infringing, and suitable for your use. You must not use these features to create unlawful, deceptive, or harmful deepfakes or other prohibited synthetic media.

AI Website / Site Builder

Website drafts and related outputs are starting points only. You are responsible for reviewing, editing, and ensuring that any site content, claims, branding, contact details, and legal pages are accurate and compliant before publication or commercial use. Publish and domain features may be limited or unavailable in early phases.

Prohibited Uses

You must not use PixCutly to:

• Violate copyright, trademark, privacy, publicity, or other rights
• Upload or generate illegal, exploitative, or prohibited content
• Impersonate others or create deceptive synthetic media without lawful basis
• Attempt unauthorized access, disrupt, reverse engineer, or attack the platform
• Overload, scrape, or automate the service in a way that interferes with normal operation or violates rate limits
• Bypass security, authentication, or usage controls
• Violate applicable law or third-party provider terms

Free Features, Limits, and Future Pricing

PixCutly may offer free features, usage limits, rate limits, and/or paid plans now or in the future. Feature availability, models, providers, and limits may change.

Displayed plan cards, checkout screens, or credit indicators may be informational or preview UI. Paid checkout and payment processing are not currently an active public purchasing flow. If paid services become available, applicable pricing and payment terms will be presented before purchase.

We do not invent or guarantee specific credit balances, refunds, SLAs, or subscription entitlements in these Terms beyond what is expressly offered at the time of use.

Intellectual Property

PixCutly's website, branding, logos, software, interfaces, designs, and other platform materials are owned by or licensed to Ainan Signage Company and protected by applicable law. These Terms do not transfer ownership of PixCutly platform materials to you, and do not transfer ownership of your original User Content to Ainan Signage Company.

Third-Party Services

PixCutly may rely on third-party services, including authentication and databases (Supabase), Google authentication, Google AI / Gemini APIs, Google Analytics when configured, OpenAI for certain AI assistance features, and email/SMTP providers for contact delivery.

Your use of features that depend on those services may be subject to the providers' own terms and policies. We are not responsible for third-party services we do not control.

Availability and Changes

PixCutly may be unavailable due to maintenance, outages, upgrades, provider issues, or events beyond our control. Continuous availability is not guaranteed.

We may modify, suspend, replace, or discontinue features, models, voices, providers, limits, or interfaces at any time.

Suspension and Termination

Ainan Signage Company may restrict or terminate access where needed for abuse, security issues, violation of these Terms, illegal activity, or protection of the service and its users.

Disclaimers

To the maximum extent permitted by law, PixCutly is provided "as is" and "as available." We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, and accuracy of AI or image-processing outputs, except where such disclaimers are not allowed.

Limitation of Liability

To the maximum extent permitted by applicable law, Ainan Signage Company will not be liable for indirect, incidental, consequential, special, exemplary, or similar damages, or loss of profits, data, goodwill, or business opportunities, arising from your use of or inability to use PixCutly.

Indemnification

To the extent permitted by applicable law, you agree to be responsible for claims arising from your unlawful use of PixCutly, your User Content, your use of Generated Content, infringement of third-party rights, or violation of these Terms.

Privacy Policy

Our collection and use of personal information is described in the PixCutly Privacy Policy. By using PixCutly, you also acknowledge that policy.

Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date will reflect revisions. Continued use after changes are posted means you accept the updated Terms.

Governing Law

These Terms are governed by the applicable laws of India.
